儲值卡一般條款及細則

本文件為世一電訊旗下所有旅遊儲值卡（包括實體 SIM 卡及 eSIM，統稱「產品」）之通用條款與細則。產品以數據服務為主，於香港以外地區使用，不設合約期。各產品如另附「特別條款」或包裝標示與本文件不一致者，以該等特別條款為準；未載明者，以本條款為準。
1 合約文件層級
1.1 本合約由下列文件構成（優先次序由高至低）：
• 產品包裝或銷售頁所載「特別條款」
• 本《儲值卡一般條款及細則》
• 本公司不時公布之適用政策（如私隱政策、公平使用政策）
1.2 如文件之間出現矛盾，以上列次序較先者為準。
2 啟用及有效期
2.1 產品必須於包裝所示「最後啟用日期」前啟用，否則視為作廢，費用不獲退還。
2.2 啟用時刻起連續計算產品標示之有效天數，每 24 小時為一日。例如 3 日卡於 13:00 啟用，服務將於 72 小時後（即啟用後第三日同一時刻）自動終止。
2.3 除特別條款另有說明，產品為一次性、不設增值；有效期屆滿或高速流量／FUP 配額耗盡且屬「用完即停」產品後，服務即終止。
3 服務範圍與公平使用
3.1 產品僅提供流動數據服務（不含話音、短訊及 IDD），並須使用於無 SIM 鎖且支援 LTE/5G 之裝置。
3.2 數據最小計費單位 1 KB；本公司網絡紀錄為最終計算依據。
3.3 公平使用政策：除標示「用完即停」者外，每張卡載有高速流量或每日流量上限；達上限後，數據速率將降至不低於 384 kbps 直至有效期完結。
4 國際漫遊網絡
4.1 客戶必須在目的地連接包裝或官網指定之合作網絡；合作網絡如有更改，以官網公告為準。
4.2 若客戶選擇非指定網絡而產生任何額外費用，本公司概不負責。
5 實名登記
5.1 產品主要於境外使用，一般無需於香港完成《電話智能卡實名登記》；惟客戶若在香港境內啟用或使用產品，必須遵守《電訊（登記用戶識別卡）規例》及相關法規，自行確保合規。
6 暫停與終止
6.1 以下情況將立即終止服務，餘額及有效期不予退還：
(a) 有效期屆滿；(b) 高速／FUP 流量耗盡且屬「用完即停」卡；(c) 產品被發現用於欺詐、非法或商業用途。
6.2 產品一經終止，卡號將無法保留或恢復；任何未用流量、剩餘天數或誤存金額概不退還或轉讓。
7 退款及更換政策
7.1 產品一經啟用或撕開包裝，即視為已使用，不得退款。
7.2 除非產品在使用前或啟用前已存在錯誤或損毀，否則不可轉換或退款。如確定有以上情況，可於購買 7 天內憑收據更換相同的產品，但不可換取現金、服務或其他產品；如涉及運送安排，額外的運費及關稅須由客戶承擔。
7.3 若產品是經由第三方經銷商或特許經營商戶購買，則任何有關產品更換的事宜應向該第三方經銷商或特許經營商戶提出，並由其負責處理。
7.4 產品遺失、被盜或損毀，本公司不設補發或退款。
8 責任限制
8.1 在適用法律允許範圍內，本公司對因服務中斷、網絡擁塞、漫遊夥伴故障或不可抗力引致之損失或損害，不負任何直接或間接責任。
8.2 如任何法庭裁定本公司須承擔賠償責任，最高賠償額以客戶就相關產品實際已支付之金額為上限。
9 私隱與資料使用
本公司將按照《私隱政策》及適用法律收集及處理個人資料；客戶使用產品即代表同意該政策。
10 通告
10.1 本公司可透過官網公告、電郵、SMS 或推送訊息發出任何條款變更或服務通知；通知一經發出即視為已送達。
10.2 如涉及服務收費增加，本公司將於生效日前最少 30 天於官網公告。
11 適用法律與管轄
本條款受香港特別行政區法律管轄，並以香港法院為專屬管轄法院。
12 定義
「高速流量」：可於完整網速下使用之數據量。
「用完即停」：一旦高速流量或總流量達上限即終止服務之產品類型。
「FUP 降速」：達公平使用門檻後，速率限制至 384 kbps 之安排。

本公司保留隨時修訂本條款之權利。
General Terms & Conditions for Stored‑Value Travel SIM Cards
Company Name: TOP1 TELECOM LIMITED
These Terms & Conditions ("Terms") apply to all travel prepaid SIM products (physical SIM and eSIM, collectively the "Products") marketed by TOP1 TELECOM. The Products provide data service only, are intended for use outside Hong Kong, and carry no minimum contract term. Where a Product package or sales page sets out Special Terms inconsistent with this document, the Special Terms prevail.
1 Contract Hierarchy
1.1 Each contract consists of the following documents, in descending order of precedence: • Special Terms stated on the product package or sales page; • These General Terms & Conditions; • Policies published by the Company from time to time (e.g., Privacy Policy, Fair Usage Policy).
1.2 If there is any conflict, the document listed higher prevails.
2 Activation & Validity
2.1 The Product must be activated on or before the "Last Activation Date" printed on the package; otherwise, it will be void and non‑refundable.
2.2 Validity is counted in consecutive 24‑hour blocks from the exact activation time. For example, a 3‑day card activated at 13:00 expires 72 hours later (the same time on the third day).
2.3 Unless stated otherwise in Special Terms, the Product is single‑use and non‑rechargeable. Service ends when the validity period expires or, for "use‑up‑then‑stop" cards, when the high‑speed/FUP quota is exhausted.
3 Service Scope & Fair Usage
3.1 Products provide mobile data service only (no voice, SMS, or IDD) and must be used in an unlocked LTE/5G‑capable device.
3.2 Data is measured in 1 KB increments; the Company’s network records are final.
3.3 Fair Usage Policy: Except for "use‑up‑then‑stop" cards, each card includes a high‑speed data quota. After reaching the quota, data speed is throttled to not less than 384 kbps until the validity ends.
4 International Roaming Networks
4.1 Customers must connect to the partner networks specified on the package or website; any changes will be announced on the website.
4.2 The Company is not liable for charges incurred on non‑designated networks.
5 Real‑Name Registration
5.1 Products are primarily intended for overseas use and generally do not require Hong Kong real‑name registration. Customers who activate or use the Product within Hong Kong must comply with local SIM registration laws at their own responsibility.
6 Suspension & Termination
6.1 Service terminates immediately, with no refund of unused quota, when: (a) Validity expires; (b) High‑speed/FUP quota is exhausted for a "use‑up‑then‑stop" card; or (c) The Product is used for fraudulent, illegal, or commercial purposes.
6.2 Once terminated, the SIM number cannot be retained or reinstated; any unused data or mistaken top‑up is non‑refundable and non‑transferable.
7 Refund & Replacement Policy
7.1 No refunds once the Product is activated or the package seal is broken.
7.2 Unless the product has defects or damages present before use or activation, it cannot be exchanged, transferred, or refunded. If such conditions are confirmed, the product may be exchanged for the same model within 7 days of purchase, upon presentation of a valid receipt, but cannot be exchanged for cash, services, or other goods. In cases involving shipping arrangements, any additional shipping costs and tariffs shall be borne by the customer.
7.3 If the product was purchased through a third-party distributor or authorized dealer, any issues related to product replacement should be addressed to the respective third-party distributor or authorized dealer, who shall be responsible for handling such matters.
7.4 The Company does not replace or refund lost, stolen, or damaged Products.
8 Liability Limitation
8.1 To the extent permitted by law, the Company shall not be liable for any direct or indirect loss arising from service interruption, network congestion, roaming partner failure, or force majeure.
8.2 If a court determines the Company must pay compensation, the maximum liability is limited to the amount paid by the customer for the affected Product.
9 Privacy & Data Use
Personal data will be collected and processed in accordance with the Company’s Privacy Policy and applicable laws.
10 Notices
10.1 The Company may issue notices of term changes or service announcements via its website, email, SMS, or push notifications; such notice is deemed delivered when sent.
10.2 Fee increases will be announced on the website at least 30 days before taking effect.
11 Governing Law & Jurisdiction
These Terms are governed by the laws of the Hong Kong SAR, and the Hong Kong courts shall have exclusive jurisdiction.
12 Definitions
"High‑speed data" – Data usable at full network speed. "Use‑up‑then‑stop" – Product type that ceases service once the high‑speed or total data quota is reached. "FUP throttling" – Speed restriction to 384 kbps after reaching the Fair Usage threshold.
